1. Introduction

(1) These Terms and Conditions ("Terms") govern every contract concluded through the online shop at accord.com between the operator of accord.com (hereinafter "ACCORD", "we", "us") and the shopper (hereinafter "you", "Buyer"). Our selection covers products across the home and garden categories.

(2) For the purposes of these Terms, a consumer is any individual entering into a legal transaction for purposes that cannot predominantly be attributed to commercial or independent professional activity. A business buyer is any individual, legal entity, or partnership with legal capacity acting in the exercise of their commercial or self-employed professional activity when concluding the contract.

(3) Any differing, conflicting, or supplementary terms proposed by the Buyer shall become part of the contract only where their applicability has been expressly acknowledged by us in writing.

2. Contracting Party and Point of Contact

3. Formation of the Contract

(1) The display of our home and garden products within the online shop does not constitute a legally binding offer, but functions as a non-binding invitation for you to place an order.

(2) By clicking the "Buy" / "Place order" / "Pay now" button, you make a binding offer to purchase the items listed in your shopping basket.

(3) Confirmation of receipt and acceptance of the order occur at the same moment — both are communicated to you promptly following the submission of your order by way of an automatically generated email. Upon the sending of this confirmation email, the contract of sale becomes legally binding.

(4) We retain the contract text and provide it to you together with these Terms by email. The applicable version of these Terms is also available for review at any time at accord.com/terms-of-service.

(5) Contracts are concluded in the English language.

4. Prices and Delivery Costs

(1) All prices shown on the website include the applicable statutory Value Added Tax. Any additional shipping and delivery charges are displayed separately during the ordering process.

(2) For deliveries to countries outside the European Union and the United Kingdom, further customs duties, import taxes, and additional levies may apply, which are payable by the Buyer.

5. Payment

(1) The following payment methods are supported: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay, and bank transfer. We reserve the right, in specific cases, not to offer individual payment methods.

(2) The purchase price becomes payable upon conclusion of the contract.

(3) When paying by credit card or PayPal, the relevant amount will be charged to your payment account immediately upon completion of the order.

6. Delivery

(1) Delivery is made to the delivery address supplied by the Buyer. Specific delivery times are shown clearly on the respective product page as well as throughout the ordering process.

(2) Should delivery prove impossible despite three attempts, we are entitled to withdraw from the contract. Any payments already received shall be refunded to you without delay in such an event.

(3) Where delays arise as a result of force majeure, the delivery period shall be extended accordingly. We shall notify you of any such delay promptly.

7. Retention of Ownership

The goods delivered remain our property until the purchase price has been paid in full.

8. Consumer Right of Cancellation

Consumers benefit from a statutory right of cancellation. Full information about this right, together with the model cancellation form, may be found on our Cancellation Policy page.

9. Warranty and Liability for Defects

(1) The statutory rules on liability for defects apply. For consumers, the limitation period for claims arising from defects in the goods is two years from the date of delivery.

(2) For second-hand goods, the limitation period is shortened to one year from the date of delivery.

10. Liability

(1) We accept unlimited liability in cases of intent and gross negligence, and within the scope of consumer protection legislation.

(2) In cases of simple negligence, our liability is limited to breach of a material contractual obligation (a so-called cardinal duty), the fulfilment of which is essential for proper performance of the contract and on the observance of which the Buyer regularly relies. In such situations, liability is capped at the level of foreseeable damages typical of the contract.

(3) The above shall not affect our liability for injury to life, body, or health.

11. Dispute Resolution

(1) The European Commission maintains an Online Dispute Resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr.

(2) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.

12. Applicable Law and Jurisdiction

(1) The contractual relationship shall be governed exclusively by the laws of England and Wales, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In respect of consumers, this choice of law applies only to the extent that the protection afforded by mandatory provisions of the law of the country of the consumer's habitual residence is not thereby withdrawn.

(2) If the Buyer is a merchant, a legal person under public law, or a special fund under public law, the place of our registered office shall be the place of jurisdiction for all disputes arising from this contractual relationship.

13. Concluding Provisions

Should any individual provision of these Terms prove to be wholly or partly invalid, the validity of the remaining provisions shall remain unaffected. Any invalid provision shall be replaced by the corresponding statutory rule.
